PergolaProof

Privacy Policy

Last updated: 7 September 2026

Who this policy covers

This Privacy Policy explains how Fleet and Fury LLC ("we," "us"), a Wyoming limited liability company operating PergolaProof (and trading as Freshpixl in some marketing), collects, uses, and protects information in connection with the service.

This policy covers two kinds of people: contractor businesses who hold a PergolaProof account ("Customers," "you"), and the homeowners who use a Customer's visualizer ("visitors" or "homeowners"). Where it matters, the relevant section says which group it's about.

Information we collect

From Customers (contractor accounts):

  • Business name, contact details, and billing information (billing is processed by Stripe; we do not store card numbers ourselves).
  • Product catalog content — photos, descriptions, pricing, and related material you upload so we can build your visualizer.
  • Account activity, such as login history and dashboard usage.

From homeowners (visitors to a Customer's visualizer):

  • A photo of their property, submitted so the visualizer can generate a render.
  • Contact details and any other information they provide when submitting the form (name, phone, email, chosen design).
  • Basic visit data — for example, that a visit occurred and roughly when — used to show Customers their traffic and lead counts.

We collect homeowner information on behalf of, and on the instructions of, the Customer whose visualizer the homeowner used. As between us and the homeowner, the Customer is the business responsible for that data; we process it under the Data Processing Addendum referenced in our Terms of Service.

How we use information

We use the information above to:

  • Build and operate a Customer's visualizer, including training the catalog model.
  • Generate renders and deliver completed leads to the Customer's dashboard.
  • Process payments and manage billing.
  • Send account, billing, and lead-alert notifications (Customers can turn off lead alerts in the dashboard; billing and account notices are always sent).
  • Provide customer support and investigate reported issues.
  • Maintain and improve the service, using anonymized, non-identifying usage statistics where possible.

Who we share information with

We do not sell homeowner or Customer data. We do not share a Customer's leads — names, contact details, traffic sources, or marketing channels — with any third party, except the service providers described below, each of which processes data only to help us deliver the service and under confidentiality obligations:

  • Payment processing: Stripe, to process subscription and setup fee payments.
  • Hosting and infrastructure: cloud hosting providers, to run the platform and store data securely.
  • AI model providers: the underlying providers we use to generate image and video renders. Catalog photos and homeowner property photos are processed by these providers solely to produce renders for the relevant Customer's visualizer.

We may disclose information if required by law, to enforce our Terms of Service, or to protect the rights, property, or safety of PergolaProof, our Customers, or others.

Data retention

We retain Customer and homeowner data for as long as the Customer's subscription is active. After an account is cancelled or terminated, catalog data and lead records are retained for 90 days to allow for export, after which they may be deleted. Customers can export their lead records from the dashboard before this period ends.

Security

We use reasonable technical and organizational measures to protect the data we hold, including relying on providers (such as Stripe) that maintain their own security and compliance standards for payment data. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.

Homeowner rights and choices

A homeowner who wants to know what information a Customer holds about them, or who wants it corrected or deleted, should contact the contractor business (Customer) whose visualizer they used, since the Customer is the business responsible for that data. If a homeowner contacts us directly, we will forward the request to the relevant Customer and can assist with technical fulfillment where needed.

Depending on where a homeowner is located, they may have additional rights under applicable law (for example, state privacy laws in the US). Contact privacy@pergolaproof.com with questions about exercising those rights.

Cookies and similar technologies

Our dashboard and visualizer widget may use cookies or similar technologies to keep Customers logged in, remember dashboard preferences, and measure visit and lead counts shown on your dashboard. We do not use this data to build advertising profiles of homeowners.

Children's privacy

PergolaProof is a business-to-business service intended for contractor accounts and their adult customers. It is not directed to children, and we do not knowingly collect information from anyone under 18 through the visualizer's contact form.

Changes to this policy

We may update this Privacy Policy from time to time. For material changes, we will notify the Customer account owner before the change takes effect, consistent with how we handle changes to our Terms of Service.
